Terms
Terms of Service
Last updated: 28 October 2026
These terms apply to businesses that use PayPathIQ (“you”, the “Client”). They are provided by PayPathIQ Limited, registered in Ireland under company number 814270, registered office Venture Hub, 136 Capel Street, Dublin 1, D01 T2C9, Ireland (“PayPathIQ”, “we”).
1. The agreement
Your agreement with us is made up of your order form or pilot agreement, these terms, our data processing agreement, and our Acceptable Messaging Policy. If they conflict, the order form wins, then the data processing agreement, then these terms.
2. The service
PayPathIQ is software-as-a-service for billing workflows, payment reminders, customer outreach, payment links, and reconciliation. It lets you contact your own customers about their existing accounts by SMS, email, phone, and post, and lets them pay you through your own payment provider.
PayPathIQ is a software provider. We are not a debt collection agency, a payment institution, or the merchant of record, and we do not give legal, financial, or regulatory advice. Money paid through PayPathIQ goes to your payment provider account, not to us.
3. Accounts and access
You are responsible for the people you give access to, for keeping sign-in details secure, and for everything done under your accounts. Tell us at once if you suspect unauthorised access.
4. Your responsibilities
You agree that you will:
- have a lawful basis to contact each customer you upload or connect, and tell your customers, in your own terms or privacy notice, that you may contact them by SMS, email, phone, or post about their account;
- keep customer data accurate and up to date, and act promptly on corrections and objections;
- approve the wording, timing, and frequency of the messages and workflows you run;
- honour opt-outs and contact preferences, which PayPathIQ records and applies automatically;
- comply with laws that apply to your business and your communications, including data protection, consumer protection, and electronic communications law; and
- follow our Acceptable Messaging Policy.
5. Messaging and sender names
PayPathIQ may be used only for transactional messages about an existing account, such as invoice notices, payment reminders, payment links, and payment confirmations. It must never be used for marketing or promotional messages.
SMS is sent under the PayPathIQ sender name or a sender name for your business. A sender name for your business is used only after you confirm in writing that you authorise us to send on your behalf, and only once it is registered with ComReg. We may refuse or withdraw a sender name that could mislead recipients.
6. Payments
Card and bank payments are processed by your payment provider, such as Stripe or Global Payments, under that provider's own terms with you. We never handle or store full card numbers or security codes. You are responsible for refunds, chargebacks, and disputes with your customers.
7. Data protection
For your customers' personal data, you are the controller and we are your processor. Our data processing agreement sets out how we handle that data, the security measures we apply, and how we use sub-processors. Our current sub-processors are listed on our sub-processors page. For data we control ourselves, our Privacy Policy applies.
8. Fees
Fees, billing periods, and payment terms are set out in your order form or pilot agreement. Fees exclude VAT, which is charged where it applies.
9. Suspension
We may suspend a messaging channel, a sender name, or your access straight away if we reasonably believe it is needed to stop a breach of law, of these terms, or of our Acceptable Messaging Policy, to protect recipients, or to meet a requirement of a network operator, ComReg, or another regulator. Where we can, we will tell you first and restore access once the issue is fixed.
10. Confidentiality and intellectual property
Each of us will keep the other's confidential information confidential. You keep all rights in your data. We keep all rights in the PayPathIQ software and service. You may not copy, resell, or reverse engineer the service.
11. Liability
Except where the law does not allow it to be limited, our total liability to you in any 12-month period is capped at the fees you paid us in the 12 months before the event giving rise to the claim. Neither of us is liable to the other for indirect or consequential loss, or for loss of profit, revenue, or goodwill. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
12. Term and termination
Your agreement runs for the term in your order form. Either of us may end it if the other commits a material breach and does not fix it within 30 days of written notice. After it ends, you have 30 days to export your data, after which we delete it unless the law requires us to keep it.
13. Changes to these terms
We may update these terms. We will give you at least 30 days' notice of material changes, unless a change is required by law or a regulator sooner.
14. Governing law
These terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction. Before going to court, each of us will first try in good faith to resolve a dispute through senior contacts.
